Consumer Health Data Privacy Policy

This policy supplements the Smidgio Privacy Policy and describes how Runaq.ai handles "consumer health data" as defined by the Washington My Health My Data Act (ch. 19.373 RCW). It applies to Washington consumers and to anyone whose consumer health data is collected in Washington.

1. Categories of Consumer Health Data We Collect

  • Mood and emotional-state notes - if you tell our assistant how you are feeling, it may remember a short note about it (for example, "felt overwhelmed this week") for up to 90 days.
  • Wellbeing-related content signals - your interest in health topics, content rules you set that relate to wellbeing, and inferences used to pick supportive content (for example, selecting calmer framing or emotional-regulation material).
  • Legacy personality scores - some early accounts include personality scores covering emotional sensitivity. We no longer create these for new users.
  • Safety signals - if our safety filter is enabled and your message indicates a crisis, we process that message to respond with support resources. That filter is not currently enabled.

We do not collect diagnoses, medical records, biometric data, or precise location, and we do not use geofencing of any kind.

2. Sources

This data comes from what you write or say to the assistant on WhatsApp, and from inferences our AI models draw from those conversations.

3. Purposes

We collect and use this data only to personalize the content, tone, and framing of your episodes and the assistant's replies, and, if the safety filter is enabled, to show you crisis-support resources.

4. Consent and Control

We do not ask you for mood or wellbeing information. It is collected only from what you volunteer in conversation with the assistant.

You can ask the assistant to forget a specific fact, pause deliveries, or delete your account and all associated data at any time. Mood notes are also deleted automatically 90 days after they are recorded.

To be direct about a gap rather than imply otherwise: Smidgio does not yet offer a separate, optional consent choice for wellbeing memory at onboarding, distinct from your acceptance of the Terms and Privacy Policy. Building one is a known outstanding requirement.

5. Sharing

We do not sell consumer health data, and we will never sell it without the signed authorization the law requires. We do not share it with third parties for their own purposes. It is processed on our behalf by the service providers listed in the Privacy Policy (Amazon Web Services and our AI and text-to-speech providers) under contracts that restrict their use of it. A list of the third parties with whom your consumer health data has been shared is available on request.

6. Your Rights

You have the right to:

  • Know and access the consumer health data we hold about you, including the third parties with whom it was shared.
  • Withdraw consent to further collection or sharing.
  • Delete it - say "delete my data" to the assistant or use your portal. Deletion also removes it from our processors and backups within the timelines the law requires.

We will not discriminate against you for exercising these rights. To exercise them, message the assistant or email contact@runaq.ai. If we refuse a request, you may appeal by replying to our decision; if the appeal fails, you may contact the Washington State Attorney General at atg.wa.gov.
